Subscription & Device Terms and Conditions
These Terms & Conditions govern participation in the iGulu S1 Subscription Program for eligible customers in Canada (the “Program”). Please read them carefully before enrolling.
1 Eligibility
The Program is available only to individuals who:
- are at least eighteen (18) years old;
- provide a valid delivery address in currently eligible areas of British Columbia, Alberta, Quebec, or Ontario; and
- provide valid payment details and authorise recurring payments.
iGulu may expand, restrict, or change Program availability by province from time to time.
2 Program Overview
The Program gives you:
- access to an iGulu S1 home brewing device (the “Device”) during your active subscription; and
- four (4) brew kits per recurring two-month billing cycle during the subscription period.
Unless ownership is transferred in line with these Terms, the Device remains the sole property of iGulu. If your subscription ends and the Device must be returned, failing to return it may result in additional charges and lawful recovery action.
3 Initial Payment
When you enrol in the Program, you must complete both of the following at checkout:
- payment of the refundable security deposit amount displayed at checkout; and
- payment of the first recurring subscription charge displayed at checkout, covering the first four (4) brew kits for the initial two-month cycle.
Both the refundable security deposit and the subscription enrolment are required for the order to be valid. If either payment is not successfully completed, processed, or authorised, iGulu may cancel the order.
The security deposit is held separately and does not count towards your recurring subscription charges.
The security deposit is not a cap on liability. If the Device is not returned, or if there is loss, damage, or missing components exceeding the amount of the security deposit, you remain responsible for the balance due, up to the full retail value of the Device to the extent permitted by law.
4 Recurring Subscription Fee
After the initial cycle, you will be charged the recurring subscription amount shown at checkout or in your account every two (2) months.
- Each recurring billing cycle includes four (4) brew kits.
- Shipping terms, surcharges, and excluded areas, if any, will be disclosed at checkout or in your account.
Recurring subscription fees are charged automatically to your payment method on file.
Recurring subscription fees are not instalment payments and do not build equity in, or part-pay for, the Device.
5 Automatic Payments
By enrolling in the Program, you authorise iGulu to charge your payment method:
- for the initial payment at checkout; and
- for the recurring subscription charge every two (2) months until the Program ends or is cancelled.
You are responsible for keeping your payment details current and valid. Failed or declined payments may result in suspension or termination of your participation in the Program.
6 Use and Care of the Device
While the Device is in your possession, you agree to:
- use it in accordance with the instructions and safety guidance provided;
- take reasonable care of it; and
- not misuse it, modify it without authorisation, or handle it negligently.
You may be responsible for repair or replacement costs if the Device is damaged through misuse, negligence, or unauthorised modification.
7 Early Buyout Option
You may request to purchase the Device before completing the full Program term.
If an early buyout option is available, the applicable buyout price will be shown in your account or provided to you at the time of your request. The buyout amount may vary based on your subscription progress.
Recurring subscription fees are paid in exchange for brew kits and access to the Device during the Program and do not count towards any early buyout price.
8 Automatic Ownership Transfer
If you complete eighteen (18) consecutive months in the Program and:
- all payments have been successfully made and there are no outstanding balances; and
- the Device is in good working condition, subject to reasonable wear and tear, and has not been unauthorisedly modified,
ownership of the Device will automatically transfer to you, and no additional payment will be required.
Once ownership transfers under this Section, the security deposit is treated as settled and is not separately refunded.
iGulu may refuse ownership transfer where the Device shows excessive damage, significant missing components, or unauthorised modifications beyond normal use.
9 Returns, Deposit Refunds & Deductions
If your subscription ends and the Device is to be returned instead of purchased or transferred to you:
- iGulu may deduct return shipping and handling costs from your refundable security deposit;
- additional deductions may be made for missing parts, excessive damage, or condition issues beyond reasonable wear and tear; and
- any deductions will be assessed reasonably based on the returned condition of the Device and its components.
If the refundable security deposit does not fully cover those amounts, you remain responsible for the remaining balance to the extent permitted by law.
9A Failure to Return Device
If you cancel the Program or your participation otherwise ends, and you do not return the Device within fourteen (14) days after iGulu has provided return instructions, iGulu may, to the extent permitted by law:
- charge your payment method for the retail value of the Device, less any security deposit already held;
- use third-party collection or other lawful recovery methods to recover unpaid amounts; and
- seek reasonable administrative or recovery costs where recoverable.
10 Warranty, Support & Consumer Rights
iGulu provides support for manufacturing defects that are not caused by misuse, negligence, accidental damage, or unauthorised modification. Depending on the issue, iGulu may repair or replace the Device at its discretion.
Nothing in these Terms excludes, restricts, or waives any consumer rights or remedies that cannot lawfully be excluded under applicable Canadian federal, provincial, or territorial consumer protection law.
11 Suspension or Termination
iGulu may suspend or terminate your participation in the Program if:
- payments fail repeatedly or remain unpaid;
- fraud, abuse, or misuse is suspected; or
- you materially breach these Terms.
If the Program is suspended or terminated, any return obligations, outstanding charges, and applicable deductions will continue to apply.
12 Changes to the Program
iGulu may update, suspend, or discontinue the Program from time to time. Any changes will apply on a forward-looking basis and will be communicated where required by law.
13 Governing Law
These Terms are governed by the laws of the province or territory in which the participant ordinarily resides, together with the federal laws of Canada applicable there, without prejudice to any mandatory consumer protections that apply.
