1 Eligibility

The Program is available to individuals who:

• Are at least eighteen (18) years of age
• Provide a valid shipping address in eligible regions
• Provide valid payment information and authorize automatic recurring charges

iGulu reserves the right to approve or reject participation at its sole discretion.

2 Program Overview

The Program provides participants with:

• Access to an iGulu home brewing device (“Device”) on a subscription and leasing basis; and
• Ongoing delivery of brew kits during the subscription period.

3 Initial Payment

At enrollment, participants are required to complete the following payments concurrently:

• USD $150 refundable security deposit; and
• Enrollment in the monthly brew kit subscription at USD $49.99 per month.

Both the refundable security deposit and the monthly subscription enrollment are required for the order to be valid. If either component is not successfully completed, processed, or authorized, iGulu reserves the right to cancel the order at its sole discretion.

The refundable security deposit is held separately and does not apply toward subscription fees.

The Security Deposit is not a limit of liability. If the Device is not returned, or if damage, loss, or missing components exceed the amount of the Security Deposit, you remain responsible for the full balance owed, up to the full retail value of the Device.

4 Monthly Subscription Fee

Beginning in the second month, participants will be charged:

• USD $49.99 per month, which includes:
  • Two (2) brew kits per month
  • Free standard shipping

Monthly fees are charged automatically using the payment method on file.

Monthly subscription fees are not installment payments and do not contribute toward ownership of the Device.

5 Automatic Payments

By enrolling in the Program, you authorize iGulu to automatically charge your payment method:

• For the initial payment at checkout; and
• For recurring monthly subscription fees thereafter.

You are responsible for maintaining valid payment information. Failed or declined payments may result in service suspension or termination.

6 Use and Care of the Device

Participants agree to:

• Use the Device in accordance with all provided instructions;
• Maintain the Device in reasonable condition; and
• Avoid misuse, unauthorized modification, or negligent handling.

Participants are responsible for repair or replacement costs resulting from misuse, excessive damage, or unauthorized modifications.

7 Buyout Option & Pricing

Participants may elect to purchase the iGulu device (“Buyout Option”) at any time during the Program.

The Buyout price decreases over time based on the number of consecutive months the participant remains active in the Program. Buyout pricing starts at USD $349 after the first month, decreases incrementally each month, and reaches USD $0 after eighteen (18) consecutive months, subject to the conditions set forth in Section 8.

Monthly subscription fees are paid in exchange for brew kits and access to the Device and do not constitute installment payments toward ownership of the Device.

Applicable Buyout pricing will be clearly displayed in the participant’s account or at the time a Buyout request is made.

8 Automatic Ownership Transfer

If a participant completes eighteen (18) consecutive months in the Program with:

• All payments successfully processed and no outstanding balances; and
• The Device verified to be in good working condition, free from excessive damage or unauthorized modification,

ownership of the Device will automatically transfer to the participant, and no additional buyout payment will be required.

iGulu reserves the right to deny ownership transfer if the Device shows excessive wear, damage, or missing components beyond normal wear and tear.

9 Returns, Deposits & Deductions

If a participant elects to return the Device instead of exercising the Buyout Option:

• A standard return shipping and handling fee of USD $99 will be deducted from the refundable security deposit.
• Additional deductions may apply for damage, excessive wear, or missing components, as determined by iGulu at its reasonable discretion.

If the refundable deposit is insufficient to cover applicable deductions, the participant remains responsible for the remaining balance.

9A Failure to Return Device

If you cancel your subscription and fail to return the Device within fourteen (14) days of cancellation, iGulu reserves the right to:

• (a) charge your payment method on file for the full retail value of the Device, minus any Security Deposit already held;
• (b) pursue recovery of unpaid amounts through third-party collection services or other lawful means; and
• (c) recover reasonable costs associated with such recovery efforts, including legal and administrative fees, to the extent permitted by law.

10 Warranty & Support

iGulu provides warranty coverage for manufacturing defects not caused by misuse, including replacement or repair at iGulu’s discretion.

Customer support is available throughout participation in the Program.

11 Suspension or Termination

iGulu reserves the right to suspend or terminate participation in the Program in cases of:

• Payment failure;
• Fraud or abuse;
• Violation of these Terms.

Upon termination, return obligations and applicable deductions remain in effect.

12 Program Modifications

iGulu may modify, suspend, or discontinue the Program at any time. Any changes will apply prospectively and will be communicated where required by law.

13 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
